Dear Medicaid Provider Administrator:

This letter provides information about minimum wage adjustments to Personal Care (PC) and/or Consumer Directed (CDPAP) Medicaid fee-for-service (FFS) preliminary reimbursement rates for FY2023 and FY2024 taking effect on January 1, 2023 and January 1, 2024 respectively.

The FFS rates were updated in accordance with the scheduled minimum wage (MW) increases as set by the Minimum Wage Act (Article 19 of the New York State Labor Law) and the Enacted State Budgets for Fiscal Years (SFY) 2022-2023 and 2023-2024. These rates were calculated by applying the following location-based minimum wage adjustments, using the October 1, 2022 rate as the base rate, and adding applicable fringe:

NYC, and Nassau, Suffolk, Westchester County Providers N/A $1.55

The Department is currently reviewing provider-reported home care cost report changes, and the preliminary 2023 and 2024 FFS rates (per this communication) will be reconciled to final cost-based rates. Once reconciled, all providers will be notified, individual provider rate sheets will be available on the Department’s Health Commerce System (HCS) portal (rate sheets will NOT be available until rates are reconciled and final), and final cost-based rates will be posted to the Department website:

The minimum wage adjusted preliminary FY2023 and FY2024 FFS rates will take effect in eMedNY in cycle #2431, with a check release date of April 10, 2024.
